Privacy policy

CINTHA informs interested parties that their data will be processed in accordance with the limitations, rights, and obligations established by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, the General Data Protection Regulation or GDPR). In compliance with Article 13 of the GDPR, the following information is provided:

PURPOSES OF DATA PROCESSING

The data provided by interested parties will be used for the legitimate purposes established by CINTHA, specifically:

  1. To manage the provision of the contracted service, as well as additional services during the stay.

  2. To collect and process personal data through the registration form in order to manage the commercial, accounting, and administrative relationship with clients in relation to contracted services and accommodation. This processing is based on the execution of the pre-contractual relationship maintained with us.

  3. To respond to requests, inquiries, complaints, and claims submitted by guests or interested parties through the accommodation’s contact channels.

  4. To manage promotional and marketing purposes, including the sending of electronic commercial communications regarding the accommodation’s products and services, based on prior consent granted for such communications.

LEGAL BASIS FOR DATA PROCESSING

The legal basis for processing data for purposes 1 to 3 is the performance of the corresponding contractual relationship.

The communication of offers and services to CINTHA clients is based on the satisfaction of a legitimate business interest, consisting of offering clients the opportunity to contract other products in order to foster customer loyalty. The GDPR expressly allows the processing of personal data for this purpose under legitimate interest.

The legal basis for sending commercial communications to non-clients is the express and unequivocal consent obtained from the interested party.

In all cases, you have the right to object to the processing of your data, as described in this Policy.

CATEGORIES OF DATA PROCESSED

Depending on the services provided, the following categories of data may be processed:

  • Identification data: first and last name, ID card or passport, date of birth, nationality

  • Contact data: address, telephone number, email address

  • Data of children staying: name, date of birth or age

  • Credit card details necessary to process the reservation payment or guarantee it, and to pay for the stay or related services

  • Accommodation data: check-in and check-out dates

  • Preference data: bed type, food and beverage preferences, dietary requirements, or food allergies

RECIPIENTS AND DISCLOSURE OF DATA

Data will not be disclosed to third parties.

Where applicable, data may only be communicated to Public Administrations, Law Enforcement Authorities, and in cases provided for by applicable law.

DATA RETENTION

Data related to the management of the customer relationship, invoicing, payments, etc., will be retained for the duration of the contractual relationship. Once the contractual relationship has ended, the data will be retained for the period required by applicable legislation and until any potential liabilities arising from the contract have expired.

Data processed for the sending of commercial communications and the creation of commercial or service profiles will be retained indefinitely until the data subject requests their deletion.

RIGHTS OF DATA SUBJECTS

CINTHA guarantees the exercise of the following rights:

Access and rectification: The right to obtain confirmation as to whether we are processing personal data and to access such data, as well as to request correction of inaccurate data.

Erasure: The right to request deletion of data when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

Restriction of processing: Data subjects may request restriction of processing or data portability, in which case we will only retain the data for the establishment, exercise, or defense of legal claims.

Objection: Data subjects may object to the processing of their data in certain circumstances provided for in the GDPR. In such cases, we will cease processing the data, or cease processing it for the specific purpose in question, unless there are legitimate grounds or for the establishment, exercise, or defense of possible claims.

Data portability: You may request the download of your personal data for portability purposes, as well as request that it be transmitted to another entity.

How to exercise your rights: The rights described above may be exercised by contacting CINTHA via the email address indicated in the “Data Controller” section of this Privacy Policy. You will be properly informed about the procedure for exercising these rights.

Right to lodge a complaint: In the event of any violation of your rights, particularly if you have not obtained satisfaction in exercising them, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) or with any other competent supervisory authority. You may also obtain further information about your rights by contacting these authorities.
